Q: Can my beneficiaries get stretch distributions of my IRA without an IRA Stretch and Protection Trust?
A: Maybe.  Properly designated, your beneficiaries will qualify for stretch distributions.  However, the possibility that they can receive stretch distributions does not mean that they will.  The purpose of the IRA Stretch and Protection TrustSM is to remove the various possibilities that distributions might be made any earlier than required (whether because of creditor claims, bankruptcy, divorce or a beneficiary's personal desires).  The purpose is to enforce Required Minimum Distributions and allow the IRA funds to continue to grow in a tax deferred environment.


Q: Can I make changes to the IRA Stretch and Protection Trust?
A: Yes!  The IRA Stretch and Protection TrustSM is completely amendable by you right up to the time of your death, allowing you to change or remove beneficiaries, adjust the amount going to each beneficiary, alter trustees, etc.  Even after you have passed away we can build in certain authority for the trustee that allows changing circumstances to be addressed.


Q: I am interested in self directed IRA investing, such as using IRA funds to invest in real estate, promissory notes, deeds of trust or other non-traditional investments that are more appropriate for a self directed IRA.  Can I still use an IRA Stretch and Protection Trust?

A: The IRA Stretch and Protection TrustSM is a retirement distribution planning vehicle.  It should be used whether you decide to invest your retirement and IRA assets in traditional IRA investments or self directed IRA investments such as real estate or deeds of trust.  Furthermore, you can use the IRA Stretch and Protection TrustSM without regard to what IRA custodian you choose to work with.
